01Acceptance of Terms & Eligibility

By creating an account on OBTO (www.obto.co), accessing our platform, connecting via our Model Context Protocol (MCP) server, or using any OBTO services, you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our services.

You represent that you are at least 18 years of age and have the legal authority to enter into this agreement. If you are using OBTO on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

02Service Description

OBTO is the first MCP-native platform for Agentic AI development and orchestration. The platform provides:

  • A deployment engine where AI agents write, provision, and deploy production applications directly from conversational interfaces (Claude Desktop, Cursor, VS Code, AntiGravity, and other MCP-compatible clients).
  • Database-native artifact storage — code is stored as database records, not as traditional files on a filesystem or Git repository.
  • Full-stack deployment capabilities — frontends, backends, API routes, and database integrations.
  • Multi-model support — model-agnostic architecture supporting OpenAI, Groq, Ollama, and open-weight models via the Model Context Protocol (MCP).
  • Glass Box observability — full audit trails, token cost tracking, and agent decision tracing.
  • Hindsight Memory Fabric — persistent memory paired with high-speed inference for improved agent performance across sessions.
  • Ecosystem products including Sofos (EdTech), Pelatis (ServiceOps), and the MCP Server Builder.
Important

OBTO is a deployment engine and orchestration platform. It is not an end-to-end guarantor of application correctness, performance, security, or fitness for any particular purpose.

03Account Registration & Security

To use OBTO, you must create an account via our registration portal or Google OAuth. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account, including actions performed by AI agents operating on your behalf.
  • Securing any API keys, MCP server configurations, or third-party credentials connected through the platform.
  • Promptly notifying OBTO of any unauthorized use of your account.

04User Ownership & Intellectual Property

Your Content

OBTO operates on the principle of "No Data Hostages." You built the workflow — it belongs to you. You retain all intellectual property rights in the application artifacts (code, routes, pages, scripts, stylesheets, templates, and data) that you create or generate through the platform.

License to OBTO

By using OBTO, you grant us a limited, non-exclusive, royalty-free license to host, execute, process, cache, and display your artifacts solely for the purpose of providing and operating the OBTO services. This license terminates when you delete your artifacts or close your account.

OBTO Intellectual Property

The OBTO platform, its underlying technology, the Glass Box dashboard, the Hindsight Memory Fabric, the MCP server infrastructure, and all associated trademarks, branding, and proprietary systems remain the exclusive property of OBTO Inc.

No Training on Your Data

OBTO does not use your application code, prompts, conversation data, or artifacts to train any machine learning models. Your data is yours.

05AI-Generated Output Disclaimer

Critical Disclaimer

All code, configurations, and application artifacts generated through OBTO are produced by third-party large language models (LLMs) operating probabilistically. AI outputs may contain errors, bugs, security vulnerabilities, performance issues, or inaccuracies.

You acknowledge and agree that:

  • AI-generated code is provided "AS-IS" without any warranty of correctness, completeness, security, or fitness for a particular purpose.
  • OBTO does not independently verify, audit, or validate any code generated by the AI models.
  • The AI may generate code that matches or closely resembles publicly available code.
  • The AI may misinterpret your intent, especially with ambiguous prompts or non-English input.
  • The quality and behavior of generated output depends on the underlying LLM selected (e.g., Claude, GPT, Qwen, open-weight models) and is subject to each model's inherent limitations.

06Deployment & User Responsibility

User Responsibility

Zero-touch deployment does not mean zero responsibility. You are the human-in-the-loop.

While OBTO enables AI agents to deploy applications to live URLs without manual deployment pipelines, you are solely responsible for:

  • Reviewing and testing all generated code before it is exposed to production users or the public internet.
  • Ensuring that deployed applications comply with all applicable laws, regulations, and industry standards.
  • Validating that deployed applications handle personal data, financial data, or sensitive information in compliance with applicable privacy and security regulations.
  • Configuring appropriate access controls, role-based permissions, and policy guardrails within the platform.
  • Monitoring the behavior of deployed Agentic workflows and intervening when necessary.

OBTO provides the Glass Box dashboard, audit trails, policy sandboxing, and observability tools to assist you in these responsibilities, but their use does not transfer liability to OBTO.

07MCP & Third-Party Integrations

OBTO is designed to work with the open Model Context Protocol (MCP) standard, enabling connections to various LLM providers, databases, and internal APIs.

You acknowledge and agree that:

  • When you select a third-party LLM (OpenAI, Groq, Ollama, etc.), your prompts and context are routed to that provider. OBTO does not control how third parties process your data.
  • You are responsible for reviewing and accepting the terms of service and privacy policies of any third-party LLM providers or integrations you connect.
  • OBTO is not liable for any data loss, breaches, or issues arising from third-party services connected via MCP.
  • Custom MCP server tools you build and host on the platform are your responsibility to secure and maintain.

08Billing, Pricing & Glass Receipt

Utility Pricing Model

OBTO operates on a transparent utility billing model. You pay for the compute and tokens your agents consume. No arbitrary seat licenses. No hidden model markups.

Subscription Tiers

  • Free Tier: Limited applications, artifacts, and token allowance. Community support.
  • Builder ($19/month): Unlimited apps, full-stack access, expanded token pool.
  • Pro / Team ($49/month): Higher compute limits, pooled tokens, SSO, roles, audit trails, up to 10 Agentic workflows.
  • Enterprise (Custom): Self-hosted / on-prem porting, BYOM, SLA, dedicated support, custom MCP integrations.

Services (Track 2)

Users may optionally purchase sprint blocks or retainers for OBTO's fractional expert co-building services, subject to separate service agreements.

Glass Receipt

Every billing cycle includes a "Glass Receipt" detailing exactly which models cost you what amounts, total token consumption, and compute usage. This is part of our commitment to radical price transparency.

Overdue payments may result in service suspension. Refund requests are evaluated on a case-by-case basis.

09Hybrid Portability

OBTO is containerized on Kubernetes by default. Enterprise users may port their entire AI runtime — including workloads, workflows, and data — to their own Kubernetes infrastructure (private cloud or bare metal).

You acknowledge that:

  • OBTO provides export tools and documentation to facilitate migration, but is not liable for issues arising from self-hosted deployments.
  • Once workloads are ported to your infrastructure, data governance and security responsibilities transfer entirely to you.
  • OBTO support for self-hosted environments is limited to Enterprise tier SLA terms.

10Prohibited Conduct

You agree not to use OBTO to:

  • Generate, deploy, or distribute malware, exploits, attack tools, or any software designed to harm systems or individuals.
  • Circumvent, disable, or tamper with the Glass Box audit trails, logging systems, or platform security mechanisms.
  • Violate any applicable local, state, national, or international law or regulation.
  • Infringe upon the intellectual property rights of others.
  • Distribute harmful, hateful, defamatory, or illegal content through deployed applications.
  • Abuse platform resources, including excessive or malicious consumption of compute or token allowances.
  • Attempt to gain unauthorized access to other users' accounts, artifacts, or workloads.
  • Use the platform for high-risk autonomous decision-making without adequate human oversight (e.g., life-critical medical systems, fully autonomous financial trading without manual intervention).

OBTO reserves the right to immediately suspend or terminate accounts engaged in prohibited conduct.

11Indemnification

You agree to indemnify, defend, and hold harmless OBTO Inc., its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the OBTO platform and services.
  • Applications you deploy using the platform, including any damages caused by rogue agents, malformed pipelines, or flawed deployments.
  • Your violation of these Terms or any applicable law.
  • Your violation of any third party's rights, including intellectual property rights.
  • Any data processed through third-party integrations connected via your account.

12Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • OBTO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM.
  • OBTO'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO OBTO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
  • OBTO IS NOT LIABLE FOR DAMAGES RESULTING FROM AI-GENERATED CODE, INCLUDING SECURITY VULNERABILITIES, BUGS, OR FUNCTIONAL DEFECTS INTRODUCED BY LANGUAGE MODELS.

13Termination

Either party may terminate this agreement at any time.

  • User-Initiated: You may close your account and cease use of OBTO at any time through your account settings. You will have a 30-day data export window following termination.
  • OBTO-Initiated: We may suspend or terminate your account for violation of these Terms, non-payment, or any conduct that threatens the security or integrity of the platform. We will make reasonable efforts to provide notice before termination, except in cases of severe violations.

Upon termination, your license to use the platform ceases. OBTO will retain your data for a reasonable period (up to 90 days) to facilitate export, after which it will be permanently deleted.

14Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration administered in New York, NY, except that either party may seek injunctive or other equitable relief in the state and federal courts located in New York County, New York.

15Modifications to These Terms

OBTO reserves the right to update or modify these Terms at any time. We will provide at least 30 days' notice of material changes via email to the address associated with your account or through a dashboard notification.

Your continued use of the platform after the effective date of any modifications constitutes your acceptance of the updated Terms.
